Financial and Real Estate Professionals Bone Up on Bankruptcy Law

On March 1, 2010, Charlotte area bankers, CPAs and Real Estate Professionals will join attorneys and paralegals in a one-day seminar called, “Nuts and Bolts of Bankruptcy Law.” This seminar will run from 9:00 – 4:30pm at Doubletree Hotel, 2600 Yorkmont Road, in Charlotte, NC, will teach the fundamentals of bankruptcy law and how to maximize every opportunity for alleviating debts during the filing process.

With 2009 personal bankruptcies filings hitting 1.41 million—up 32% from 2008—individuals experiencing financial difficulties are asking financial and real estate professionals for guidance on their legal options.

Sponsored by National Business Institute the course will be taught by a faculty including RICHARD M. MITCHELL, a partner of the the Charlotte law firm of Mitchell & Culp, PLLC, where his primary practice is bankruptcy law representing both creditors and debtors, as well as bankruptcy related litigation.

Mr. Mitchell says, “I’ve been practicing bankruptcy law for over thirty years and a great deal of my time is unfortunately spent debunking what clients have been told about their legal options by financial and real estate professionals who mean well but simply don’t know what they’re talking about. This course will make everyone’s life easier.”

Other faculty members presenting are J. SAMUEL GORHAM III, partner, Gorham, Crone, Green & Steele, LLP, of Hickory, where his areas of practice include bankruptcy, estate planning and corporate law; and ANGELA M. HEATH, an attorney in the law firm of Shuford Hunter, PLLC, in Charlotte, where she concentrates her practice in consumer bankruptcy.

The course will begin with the fundamentals of various bankruptcy chapters and their subsequent procedures of filing and litigation. Additional topics in the seminar to include: administering the means test and permitted exceptions; understanding the duties for debtor’s counsel and the rules governing bankruptcy petition preparers; how to create Chapter 13 repayment plans that satisfy creditors and clients; converting a Chapter 13 to a Chapter 7 is permitted; and conducting and analyzing client intake interviews.

The seminar will carry continuing education credit for Continuing Legal Education, Institute of Certified Bankers, International Association for Continuing Education Training and National Association of State Boards of Accountancy.
